On June 7, 2019, HB 409 “Electronic Legal Documents” was signed into law in the state of Florida. This law went into effect January 1, 2020 and authorizes Florida notaries to perform online remote notarizations or RON for short.
Currently due to the state of Florida regulations and software limitations we can only notarize documents for clients that live anywhere in the world, that are a U.S. Citizen with a valid Social Security Number and credit history. This third-party system is known as Knowledge Based Authentication, commonly referred to as KBA. If you have your credit report locked you will NOT BE Able to pass KBA.
The KBA third party software will generate 5 questions from your credit history that only the signer would know the answers to, and the signer must answer 4 or more questions correctly within 2 minutes to successfully pass. You will only get two tries to pass.
After passing the KBA requirements you will need to provide a valid US Driver License or State ID Card. The system does not currently accept Passports. The last identification requirement is a Valid US Mobile Number – VOIP, Google Voice, Cable provided lines, etc. are not accepted, and it MUST be an actual mobile number from a mobile provider. RON notarizations work with most browsers, computers with a webcam & microphone, tablets and smart phones however we don’t recommend using a smartphone. A notary public serves as an impartial witness to facilitate the workings of commerce and law by lending credibility to certain sensitive signed documents. When a document is notarized, the public can be assured that its signer is not an impostor.
It is important to note that having a document notarized does not make it legal. The notarization only proves that the person signing the document is indeed himself or herself. Additionally, the notary seal does not represent the legality of any contract or its terms. Simply put, a notary public does not notarized the document at all, only the signature is being notarized.
